The New York Income Tax

New York collects a state income tax at a maximum marginal tax rate of %, spread across tax brackets. Like the Federal Income Tax, New York's income tax allows couples filing jointly to pay a lower overall rate on their combined income with wider tax brackets for joint filers.

New York signed a sweeping tax-reduction bill into law in December 2011, creating the lowest mid-bracket tax rates in 58 years. The tax breaks are expected to affect over 4.4 million taxpayers, who will save $690 million in taxes this filing year. Despite these tax breaks, New York still has one of the highest state income tax rates in the country. Close to 10 million New York taxpayers file every year, and over 90% use New York's eFile program.

Do I need to file a New York tax return?

Generally, if you are required to file a Federal tax return New York will expect you to file a state return. If you do not have to file a Federal return, you don't need to file a state return.

How can I get an extension to file my New York income tax?

If you need an extension to file your income tax, you must file an extension request online with the Department of Taxation and Finance. Most applications will be granted an automatic 5-month extension to file.

New York Tax Deductions

Income tax deductions are expenses that can be deducted from your gross pre-tax income. Using deductions is an excellent way to reduce your New York income tax and maximize your refund, so be sure to research deductions that you mey be able to claim on your Federal and New York tax returns. 4.1 - New York Standard Deduction

Unlike many other states, New York has no standard deduction. Certain itemized deductions (including property tax, qualified charitable contributions, etc) may be allowed depending on the income level and filing type of the taxpayer. Keep in mind that not all deductions allowed on your federal income tax return are necessarily going to be allowed on your New York income tax return.

4.2 - New York Personal Exemptions

New York has no personal exemption. The Federal Income Tax, however, does allow a personal exemption to be deducted from your gross income if you are responsible for supporting yourself financially.

4.3 - New York Dependent Deduction

Unlike most states, New York does not have a dependent deduction. You can, however, claim dependent deductions on your Federal Tax Return.

4.4 - New York Itemized Deductions

New York allows limited itemized deductions. You may be able to claim most of the same deductions on your New York income tax return as you do on your Federal return, but more limitations and phase-outs may exist for higher income taxpayers. You can save time and money by electronically filing your New York income tax directly with the . New York requires you to eFile if you use eFile-enabled software to process your return and you have an Internet connection. Over 90% of New York taxpayers file online, and New York state law prevents any tax preparer for charging an extra fee to eFile your tax return.

Getting Your New York Tax Refund

If your state tax witholdings are greater then the amount of income tax you owe the state of New York, you will receive an income tax refund check from the government to make up the difference.

It should take one to three weeks for your refund check to be processed after your income tax return is recieved. E-filing your return and filing early can help ensure your refund check gets sent as quickly as possible.
